1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and CurbSofa ("Company," "we," "us," "our") governing your access to and use of the CurbSofa website, mobile application, and related services (collectively, the "Service").

By creating an account, posting a listing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately stop using the Service.

2. Description of Service

CurbSofa is an online platform that allows users to post and discover free items ("Listings") left in publicly accessible locations such as sidewalks, curbs, or driveways. CurbSofa acts solely as a neutral platform facilitating communication between users. We do not own, sell, purchase, provide, control, inspect, verify, or guarantee any items listed on the Service.

3. Eligibility

You must be at least 18 years old to use the Service. By using CurbSofa, you represent and warrant that you are 18 years of age or older. If you are under 18, you may not use the Service.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and truthful registration information.
• Promptly notify us of any unauthorized use of your account.
• Not share your account with others or create multiple accounts.

We reserve the right to suspend or terminate accounts at our sole discretion.

5. Prohibited Content and Uses

You agree that you will NOT use CurbSofa to:

5.1 Illegal Items and Activities

• Post, offer, or facilitate the transfer of stolen property or items obtained through unlawful means.
• List illegal items including but not limited to: illegal firearms, ammunition, controlled substances, counterfeit goods, explosives, or any item whose sale or transfer is prohibited by applicable law.
• Engage in any activity that violates local, state, federal, or international law or regulation.
• Use the platform to launder money or facilitate financial crimes.
• Facilitate human trafficking, exploitation, or any form of abuse.

5.2 Harmful or Dangerous Use

• Post hazardous materials, toxic waste, recalled products, or items that are known to be dangerous.
• List items that violate safety standards or pose a known risk of injury to others.
• Use the platform to stalk, harass, threaten, or harm other users.
• Arrange meetings for the purpose of committing a crime.

5.3 Fraudulent or Deceptive Activity

• Post fake, misleading, or non-existent listings.
• Impersonate another person, user, or organization.
• Claim items you have no intention of using or donate items you do not own or have the right to give away.
• Spam other users or post duplicate listings.

5.4 Platform Abuse

• Use automated bots, scrapers, or scripts to access or collect data from the Service.
• Attempt to circumvent security features, hack, or disrupt the Service.
• Upload malware, viruses, or any malicious code.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Interfere with or disrupt the integrity or performance of the Service.

5.5 No Monetary Transactions

• You must not charge any price — in cash, digital payment, cryptocurrency, barter, or any other form of compensation — for items posted on CurbSofa.
• You must not request deposits, fees, or "holding payments" from other users in connection with a listing.
• You must not use CurbSofa to facilitate sales of any kind. If you wish to sell items, please use a dedicated marketplace platform.
• Items listed on CurbSofa must be offered completely free of charge to any person who picks them up.
• CurbSofa is not a payment platform and provides no payment processing, escrow, or buyer/seller protection of any kind.

Violations of this rule — including listing items with any implied or explicit price — will result in immediate removal of the listing and may result in permanent account termination. CurbSofa is not responsible for any financial loss arising from unauthorized monetary transactions conducted through or in connection with the Service.

6. User-Generated Content

You retain ownership of content you post ("User Content"). By posting User Content, you grant CurbSofa a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your User Content for the purpose of operating and promoting the Service.

You represent and warrant that:

• You own the rights to any photos or descriptions you post.
• Your listings accurately describe freely available items you have the right to give away.
• Items you post are located in publicly accessible areas and their placement does not violate any laws or private property rights.
• Items you post do not pose any known risk of injury, contamination, or harm to others. You must not post items that are broken in a dangerous way, recalled by a manufacturer, contaminated, or otherwise unsafe for use.

We reserve the right to remove any User Content that violates these Terms or that we find objectionable, at our sole discretion, without notice.

7. Disclaimer of Warranties

To the fullest extent permitted by applicable law, CurbSofa expressly disclaims all warranties, including but not limited to:

• No verification: We do not verify the identity of users, the accuracy of listings, the condition, safety, legality, or existence of any item posted.
• No quality guarantee: We make no representations regarding the quality, safety, or suitability of any item listed on the Service.
• No transaction guarantee: We do not guarantee that any item will be available, that a pick-up will be completed, or that users will fulfill their commitments.
• No uptime guarantee: We do not guarantee that the Service will be uninterrupted, error-free, or secure at all times.

You use the Service and interact with other users entirely at your own risk. CurbSofa is not a party to any transaction or arrangement between users.

8. Limitation of Liability

Without limiting the foregoing, CurbSofa is not responsible for:

• Any injury, loss, damage, theft, or harm arising from your use of the Service or from picking up, handling, or using any item found through the Service.
• Any disputes, conflicts, or illegal acts between users.
• The condition, safety, or legality of any item listed.
• Items that are misrepresented, no longer available, or already taken.
• Any criminal activity by third parties facilitated through the platform.
• Personal safety incidents that occur during item pick-up or drop-off meetings.
• Any data loss, account breach, or unauthorized access to your account.
• Any actions taken by law enforcement related to items listed on the Service.

In no event shall CurbSofa's total cumulative liability to you exceed the greater of (a) the amount you paid to CurbSofa in the twelve (12) months preceding the claim, or (b) USD $100.

9. Indemnification

You agree to defend, indemnify, and hold harmless CurbSofa and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service.
• Any User Content you post.
• Your violation of these Terms.
• Your violation of any law or third-party rights.
• Any transaction or interaction between you and another user.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

Location data is used solely to display nearby listings and to tag item locations. We do not sell your personal data to third parties.

11. Safety and In-Person Meetings

CurbSofa is not responsible for your personal safety during any in-person interaction arranged through the Service. You acknowledge that:

• Meeting strangers involves inherent risks that you voluntarily assume.
• You should inspect items carefully before taking them.
• You should not enter private property without permission.
• If you witness illegal activity, you should contact local law enforcement immediately.

12. Intellectual Property

All content on the Service other than User Content — including the CurbSofa name, logo, design, text, graphics, and software — is owned by or licensed to CurbSofa and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from such content without our express written permission.

13. Termination

We reserve the right to suspend or permanently terminate your account and access to the Service, without prior notice or liability, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action lawsuit.

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email or a prominent notice within the Service at least 7 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
